Terms and Conditions

Welcome to Columbus Cars Agadir (“we,” “us,” or “our”). By renting a vehicle from us, you (“the Renter,” “you”) agree to be bound by the following Terms and Conditions. Please read them carefully before proceeding with your reservation.

1. Definitions

  • “Agreement” refers to this Terms and Conditions document and any separate Rental Agreement you sign at the time of pickup.
  • “Vehicle” refers to the car or any other type of automobile rented under this Agreement.
  • “Renter” or “You” refers to the individual, company, or entity renting the Vehicle.

2. Eligibility

  1. Age Requirement: You must be at least 21 years old to rent a Vehicle from Columbus Cars Agadir. Certain Vehicle categories may require you to be 25 or older.
  2. Driving License: You must possess a valid driving license held for a minimum of 2 years. International renters may require an International Driving Permit (IDP) in addition to their national license.
  3. Identification: A valid passport or national ID card must be presented upon pickup.
  4. Payment Method: A valid credit or debit card is required for security deposit and rental charges (unless otherwise agreed).

3. Reservations and Rental Period

  1. Reservation Confirmation: A reservation is considered confirmed once we have received a deposit or payment according to our current policy.
  2. Rental Start and End: The rental period starts when you take possession of the Vehicle and ends when the Vehicle is returned to our location or other agreed-upon destination.
  3. Early Returns or Extensions: If you return the Vehicle before the agreed return date, you may not be entitled to a refund for unused rental days. Extensions may be granted subject to availability and additional charges.

4. Vehicle Condition and Use

  1. Inspection: You are responsible for inspecting the Vehicle’s condition upon pickup. Any existing damages should be noted in the Rental Agreement to avoid disputes.
  2. Proper Use: You agree to operate the Vehicle responsibly and in accordance with all Moroccan traffic laws. Off-road driving is prohibited unless expressly permitted and noted in the Rental Agreement.
  3. Unauthorized Drivers: Only drivers listed in the Rental Agreement are permitted to operate the Vehicle.
  4. Prohibited Activities: You must not use the Vehicle for racing, towing, driving lessons, or any illegal activities.

5. Insurance and Liability

  1. Basic Insurance: Unless stated otherwise, our rentals include basic insurance with a deductible, which limits your financial responsibility for damage, theft, or loss of the Vehicle.
  2. Additional Coverage: You may purchase optional coverage (e.g., collision damage waiver, personal accident insurance). Refer to the Rental Agreement for pricing and details.
  3. Accidents and Damages: In the event of an accident, theft, or damage, you must inform Columbus Cars Agadir immediately and follow the proper legal procedures, including obtaining a police report. Failure to do so may void your insurance coverage.
  4. Personal Belongings: We are not responsible for damage, theft, or loss of personal items left in the Vehicle.

6. Security Deposit and Payment

  1. Security Deposit: A security deposit is required at the time of pickup. The deposit amount varies depending on the Vehicle category and insurance coverage. We will hold the deposit until the Vehicle is returned in satisfactory condition.
  2. Payment of Rental Charges: Full payment for the rental period and any additional services (e.g., GPS, child seats) is due at the commencement of the rental, unless otherwise agreed.
  3. Late Payments: If payment is not settled by the agreed-upon time, late fees may apply, and we reserve the right to take legal actions to recover outstanding balances.

7. Fuel Policy

  1. Full-to-Full: Unless otherwise stated, we operate on a full-to-full fuel policy. You will receive the Vehicle with a full tank of fuel and must return it with a full tank. Failure to do so may result in refueling charges.
  2. Fuel Type: You are responsible for using the correct fuel type. Any damage caused by using the wrong type of fuel will be charged to you.

8. Breakdown and Roadside Assistance

  1. Mechanical Issues: If you experience a mechanical issue or breakdown, contact Columbus Cars Agadir immediately. We will arrange for roadside assistance or a replacement Vehicle, subject to availability.
  2. Unauthorized Repairs: You must not authorize any repairs or modifications to the Vehicle without prior approval.

9. Cancellations and Refunds

  1. Cancellation by You: If you cancel your reservation, cancellation fees may apply, depending on how close to the rental date you cancel.
  2. No-Show: If you fail to collect the Vehicle at the agreed time without prior notice, we may treat it as a cancellation and charge a no-show fee.
  3. Cancellation by Us: We reserve the right to cancel reservations under extraordinary circumstances (e.g., vehicle unavailability, force majeure). In such cases, you will receive a full refund or a suitable replacement Vehicle if possible.

10. Traffic Fines and Penalties

  1. Responsibility: You are responsible for any traffic or parking fines, penalties, tolls, or other charges incurred during the rental period.
  2. Administration Fee: An administrative fee may be charged for processing these fines.

11. Limitation of Liability

To the fullest extent permitted by law:

  1. Indirect Damages: We shall not be liable for indirect, incidental, or consequential damages (such as lost profits, business interruption) arising out of this Agreement.
  2. Maximum Liability: Our maximum liability is limited to the total amount paid for the rental.

12. Privacy and Data Protection

  1. Use of Personal Information: We collect and process your personal information for the purpose of providing car rental services. This includes sharing details with insurance providers, law enforcement if required, and any third-party service providers involved in the rental process.
  2. Security: We take reasonable measures to protect your personal data. However, no security system is impenetrable, and we cannot guarantee absolute security of your information.

13. Indemnification

You agree to indemnify and hold harmless Columbus Cars Agadir, its employees, and affiliates from all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your breach of this Agreement or improper use of the Vehicle.

14. Governing Law and Jurisdiction

This Agreement is governed by the laws of the Kingdom of Morocco. Any dispute arising from or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the Moroccan courts.

15. Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Any changes will become effective immediately upon posting on our website. Your continued use of our services after the posting of modified Terms and Conditions signifies acceptance of the changes.
